Selling an inherited house: how to prepare the process

Start by identifying who holds rights over the property and what stage the succession process has reached. The habilitação (heirship declaration) identifies the heirs; the partilha (the division of the estate) determines the assets attributed to each one, with the corresponding registry treatment. The Balcão Heranças provides heirship, division and registration services. [1]
Only after knowing this situation should the way the parties will take part in the sale be settled. The information that “the house went to the children” is not enough to prepare a binding offer.
Is the division of the estate mandatory before selling
It should not be presented as a universal condition. A property within an undivided estate can be sold with the joint involvement of those interested, subject to the applicable conditions. Article 2091 provides for the joint exercise of rights relating to the estate, with legal exceptions. The solution must be confirmed for the specific case. [2–3]
Do not confuse selling the house with transferring an inheritance share. They are different operations and require their own framing.
1.Heirship
Identifies the heirs
2.Division
Attributes the assets to each heir

Can the cabeça de casal (estate administrator) sell alone
Administering the estate should not be confused with powers to sell a property. Before signing, clarify who must take part and whether there is adequate representation. Do not presume that the person who has been handling payments can bind all the heirs. [2]
If there are minors, people under supported-decision measures or a disagreement, obtain legal advice from the outset. These circumstances can change procedures and deadlines.
Information to gather
Prepare the available succession documents, the identification of those involved and the property's usual file. Ask the responsible professional to confirm what is missing for the chosen solution.
| Group | Information to organise |
|---|---|
| Succession | Heirship declaration, will and division, where they exist |
| Parties | Identification, contacts and representation |
| Property | Caderneta, registry certificate and available technical elements |
| Charges | Bank and condominium information |
| Tax | Relevant acquisition dates and values and documented expenses |
| Marketing | Agreement on price, conditions, viewings and handover |
How to avoid deadlocks between heirs
Before the listing, agree on a contact person and a procedure for analysing offers. Define how decisions are communicated, which documents are shared and how price adjustments will be discussed.
Illustrative example: three siblings agree to sell, but one only accepts a six-month handover period. If that condition is not known from the start, they may receive an apparently suitable offer that does not gather the necessary consensus.
A written record of the commercial conditions helps the team and interested parties. It does not replace the formalities and powers required to contract.
Heirs living abroad
Prepare representation early. Send the intended power of attorney to the entity that will formalise the deed and confirm the formal requirements and how the document may be used.
Also check availability to sign the CPCV, provide clarifications and complete the transfer. The organisation should cover the whole process, not just the final date.
How to think about capital gains
An inherited property does not automatically have a zero acquisition value. Article 45 of the CIRS defines the reference for acquisitions free of charge by link to the value relevant for Stamp Duty. Each heir should analyse their own position, share and acquisition history. [4]
Separate the tax estimate from the amounts to be distributed. The sum received by each interested party and their tax outcome should be calculated with complete information.
Frequently asked questions
Is the heirship declaration enough to close the sale
The declaration clarifies the status of heir, but the transaction also requires analysing the property, the rights, the parties and the other applicable documents.
Can one heir accept an offer on behalf of all
Only if they hold adequate powers for that purpose. Do not treat an expression of interest as proof of representation of the others.
What if one of the heirs disagrees
The disagreement needs its own solution. Do not advertise the sale of the whole as decided while the necessary conditions remain unclarified.
How long does it take
It depends on the state of the documents, the representation and the agreement between those involved. Identifying these points before marketing makes the timetable more realistic.
